Absent: Commissioner Kropke

Borough Clerk reads the following statement:

   This is a regular meeting of the Board of Commissioners of the Borough of Avon-By-The-Sea and notice of time, date and place has been transmitted to the area newspapers, Avon Board of Education, Avon Post Office and the Avon Public Library in compliance with the rules and regulations of the Open Public Meetings Law.
   Fire Exits are located in the direction I am indicating. In case of fire, you will be notified by an alarm bell. If so notified, please move in a calm, orderly manner to the nearest smoke free exit. Thank you.

Motion by Gibney seconded by Mahon that the minutes of the meeting of October 24, 2005 be approved as written and posted.

RESOLUTION offered by Gibney seconded by Mahon that,

ORDINANCE NO. 9-2005 entitled:

"AN ORDINANCE TO AMEND AND SUPPLEMENT THE
CODE OF THE BOROUGH OF AVON-BY-THE-SEA,
CHAPTER 113, LAND DEVELPOMENT."
be introduced on first reading.

Mayor Gibney explained ordinance was a completion of a year of work by the Planning Board.

Motion by Gibney seconded by Mahon that the above Ordinance No. 9-2005 shall be forwarded to the Avon Planning Board for their review and submission of a report to the Governing Body; and will be taken up on second reading with a hearing on December 12, 2005 at 7:00 p.m. in the Municipal Building.

RESOLUTION offered by Gibney seconded by Mahon that the Board of Commissioners hereby authorizes the refund of water/sewer overpayments on Block 19 Lot 12.01, 224 Sylvania Avenue, in the amount of $200.70 and Block 22 Lot 6.02 Sub 1, 105A Woodland Avenue, in the amount of $277.68.

RESOLUTION offered by Gibney seconded by Mahon that the Board of Commissioners hereby authorizes the cancellation of 2005 water/sewer charges for the following accounts:

Block 12 Lot 8 419 Norwood Ave. Overestimate $883.54
Block 15 Lot 14 Sub 1 426 Sylvania Ave., R Meter Broken $ 44.40
Block 53 Lot 2.04 17 Lincoln Ave., F Meter Broken $ 45.64
Block 15 Lot 3 431 Woodland Ave., F Demolition $913.54
Block 45 Lot 13 342 Washington Ave. Demolition $393.75

RESOLUTION offered by Gibney seconded by Mahon that the Board of Commissioners hereby authorizes the cancellation of 2005 water/sewer charges in the amount of $525.00 and one unit for Block 37 Lot 15, 309 Ocean Avenue.

Motion by Gibney seconded by Mahon that the bills in the amount of $947,216.58 be approved for payment.

Mayor asks if anyone would like to be heard?

Mayor asked department heads to given an update of their departments: Karl Klug, Water/Sewer Supt.; Terry Mahon, Police Chief; Sheila Watson, Librarian; Jeff Bramhall, D.P.W. Supt.; Charlie Rooney, Engineer.

Food for scouting this Saturday - pickup will be after 10:00 a.m.

Mayor announced Shark River Tour.

Bob Schaefer announced this evening at 8:00 p.m. the Board of Education will be holding an open house to discuss and answer questions about the December 13th school referendum for funding for an addition to the school. Discussion followed.

Motion by Gibney seconded by Kropke that being there is no further business, the meeting be adjourned.
